General Sales Conditions
These conditions have been agreed between Chameleon decor (BE0633 847 686 identification number) located Rue de Heydt No. 24a1 4608 Warsage, hereinafter referred to "chameleon-decor.com" as a trade name, and on the other hand, people wishing to make a purchase via the http://www.chameleon-decor.com website hereinafter referred to as the “user”.

1.2 General Information
The parties agree that their business relationship will be exclusively governed under this contract, excluding any other previous condition available on the website.
If a condition were to fail, it would be considered to be governed by applicable practices in force in the online sales area whose companies have their head office in Belgium.
The non-application of one or more provisions of these conditions shall never be deemed by the customer/buyer as a waiver of these terms and conditions.
These conditions aim to set the terms of sale between chameleon-decor.com and the user, from the order up to the services, through the payment and delivery.
They governall the steps necessary to place an order and ensure this order tracking between the contracting parties.
Any user not holding a customer number will have to follow a registration process to obtain, subsequently, their customer number.
In all cases, the final validation of the order implies that the user fully accepts this order, in its entirety, and at the indicated price.
This validation shall be deemed as a signature and express acceptance of all transactions made on the website.
Section 2. Terminology
Services offered by chameleon-decor.com on their website, namely product sale, will be hereinafter referred to as "chameleon-decor services", any person wishing to benefit from the services of chameleon-decor.com which would have satisfied the General conditions of Sale will be hereinafter referred to as a “client”, any company having mandated chameleon-decor.com to sell a product they own on their website, will be referred to as a “provider”, each order placed by a client under the conditions laid down will be hereinafter referred to as “the order”.
Section 3. Personal Data Records
Any individual person or entity, registering while browsing the website "http://www."chameleon-decor.com "as a potential Chameleon-decor.com Contracting Party communicates their personal data to chameleon-decor.com by registering on this website."
Registration implies the express consent that his identification data may be processed in the chameleon-decor.com database. Only legal entities or physical persons in their full ability to right and act may register.
During the registration process, the physical or legal person receives an identification number and chooses a password validated by chameleon-decor.com and this information is confirmed by an email sent by chameleon-decor.com to the client recapping these details.
The client is responsible for the proper use and for keeping his user ID and password confidential and secure.
Any use of the User ID and password is attributed to this client.
Chameleon-decor.com may temporary or permanently block the use of the user ID and password if it appears that the client fails to have complied comply with one or more provisions of these general conditions.

Such personal data are processed in the chameleon-decor.com database for customer management, order and delivery management, for invoicing tangible and intangible services, solvency tracking, advertising through profiling, for custom processing and marketing purposes.
Section 4. Privacy

Exceptionally, for additional services (information inquiry, reservation, member area, subscription to a newsletter...) personal information, mainly contact details, may be required from the user. Section 5. Price Terms
All information on products such as shipping costs and warranty, as well as prices are shown on each product corresponding description sheet.
The selling price of each product presented on the chameleon-decor.com website is expressed in Euros. This is a price including VAT (when applicable) as well as all the costs (Recupel or other), excluding any shipping costs (see art. 6 of the conditions of sale)) and additional cover.
Sales excluding VAT for those not liable to VAT, are possible subject to prior provision of documentary proof.
The price paid by the buyer, hereinafter referred to as total price, is also expressly mentioned as such when placing the order.
From 1/07/2001 under the regional conventions of environmental policies when purchasing a brand-new electrical or electronic appliance, a recycling fee has been collected on behalf of the ASBM Recupel, an authorised organisation in charge of the recovery and Euros depending on the appliance. This fee has already been included in the price.

Any order placed through chameleon-decor.com website will be delivered by GLS services.
Shipping costs for all orders will be charged as per the above table.
For a return, the return shipping costs are always borne by the client. (See art. 10 of the Conditions of Sale)
Delivery timeframe in Belgium :
Each item gives an indication of the delivery time frame based on the stock management. It may vary between 1 and 5 business days. Generally recorded delivery times vary between 24 and 48 hours for products in stock from the client order shipping by chameleon-decor.com.
For products out of stock, 10 to 30 days may be required for the order to be shipped.
Packaging and insurance:
The items you bought are packed with the utmost care, using protective materials. We take special care in packaging for a delivery in the optimal conditions. Products shipped are insured free of charge against damage and theft throughout the shipping. You must therefore verify the entirety of your order and all the items contained thereof upon delivery and in the presence of the delivery person in order to make any reservation if required.
In the event that you have any doubt whatsoever on the state or the content of the order, you are required to refuse the goods delivered. Any refused product must be returned to the carrier as a whole and in its original packaging.
In case of absence
For GLS deliveries, a delivery notice will be left in your letter box. The first time, you will be able to schedule a new delivery time by calling the phone number provided. If unfortunately, the second delivery attempt fails, you then have a period of 5 working days to withdraw your parcel from the nearest postoffice indicated on the delivery notice.
Possible loss of parcel
Despite the shipping computer tracking system a parcel may exceptionally be misdirected.

The following cases of force majeure relieve chameleon-decor.com of its obligation of deliver: war, rebellion, fire, strikes, accidents and providers regular carriers unable to supply or deliver.
chameleon-decor.com may, including in the following circumstances, temporarily suspend delivery: disruption of the internal network, fault in telephony, disruption of Internet access (difficulty) and similar causes. The performance of the agreement shall be then suspended until corrective action is taken and/or access to the Internet is restored while the buyer may not terminate the contract or claim damages.

Section 7. Terms of Order
The order is place by the client to http://www.chameleon-decor.com through the website. The command may be registered on the website only once the user is clearly identified:
- by entering his strictly personal customer number.
- by completing the online order form to obtain a customer number provided by the Customer Relations Department following his 1st order.
Any order is acceptance of the price and description of the products available for sale. (See art. 5 of the conditions of sale). By placing an order online, the client expressly declares his will to enter into a sales agreement with chameleon decor.com and agree with these general conditions. The customer’s order will be confirmed by email, hereinafter referred to as confirmation email, which summarises the terms of the order. chameleon-decor.com undertakes to deliver the orders received on the website only within the limit of stock availability. If the product in unavailable, chameleon-decor.com undertakes to advise the customer as soon as possible.
The sales contract between chameleon-decor.com, on the one hand, and the client, on the other hand, is concluded from the acceptance of the order by chameleon-decor.com.
Section 8. Payment Terms.
In order to process orders within the shortest time frame and to provide the best service, chameleon-decor.com invites the customer to pay for the purchase when placing the order. In case of cancellation of order (see art. 10 of the conditions of sale), chameleon-decor.com has the obligation to refund any amount paid by the customer, without compensation. The return shipping costs of the parcel shall be borne by the customer (see art. 10 of the conditions of sales). The purchase price is paid when ordering via the Ogone Server - www.ogone.com - (see art. 9 of the conditions of sales) used by chameleon-decor.com to securely transmit the encrypted bank details of the customer:
- Either by indicating the type of credit card (Visa, Eurocard, Mastercard), the credit card number, its expiry date and the security code by express instruction to debit the account of the credit card holder;
- Through Home Banking (ING Home'Pay, Dexia NetBanking and Dexia Direct Net, KBC Online and CBC Online).
- Or by Bancontact / Mistercash for the FORTIS, DEXIA, ING and VDK Spaarbank customers.
Autorisation : money is reserved-blocked on the buyer account, waiting to be transferred to the account of the merchant afterwards (data capture), or released when the authorisation has been cancelled. Note: Payment offline and "data capture" after the authorisation, are only possible for payment by credit card.

Section 9. Security of Electronic Funds Transfer (EFT)
Operation process on the chameleon-decor.com merchant website are carried out by the highly secure payment service provider : OGONE Company - www.ogone.com-with its head office in Brussels.
Expert in payment security, Ogone guarantees that sensitive data are transmitted and stored in accordance with the highest safety and quality standards.
How it works:
- 1. The client log in to the chameleon-decor.com website, selects items to be placed in his "shopping cart" and confirms his order.
- 2. Once registered, the customer enters the delivery and billing details. The total amount of the order inclusive of all taxes and shipping costs are then confirmed
- 3. Once he receives a full recap of his order, the customer confirms its intention to proceed to the payment step.
- 4. The customer is re-directed transparently to the Ogone website, where he will enter his payment details (payment method, home banking, credit card number,...)
- 5. Payment is requested to the relevant financial organisation.
- 6. The client receives the summary of the transaction that may be printed as a proof of payment.
- 7. chameleon-decor.com processes the order after the automated sale and ships the parcel to the customer.
When entering the payment details, (step 4), the customer is automatically redirected to the Ogone website. Sensitive information - such as credit card number is therefore exchanged between the client and the Ogone website. Chameleon-decor.com is not involved in this exchange. Not only this mechanism keeps the information confidential chameleon-decor.com, but it also allows to incorporate new methods of payment with no need to modify the merchant website programming.
In addition, all transaction costs (commissions of different financial institutions) are fully paid by chameleon-decor.com.
At the end of the payment process (step 7), return to the merchant website for the "after sale" processing of its choice (stock update, possibility to download an intangible, etc).
This system offers all the advantages for payments on the chameleon-decor.com shopping website:
- Confidential information is protected with SSL or SET technologies. No information of this type is therefore visible on the network.
- Ensure the confidentiality of payment data (including credit card numbers).

Section 10. Right to cancel
The buyer has the right to notify chameleon-decor.com of his cancellation of purchase without any penalty and has not obligation to give the reason of this cancellation within 14 working days from the day after delivery of the order.

Products shipped are insured free of charge against damage and theft throughout the shipping. You must therefore verify the entirety of your order and all the items contained thereof upon delivery and in the presence of the delivery person in order to make any reservation if required.
Chameleon-decor.com will accept the cancellation of order by the customer only if the original packaging of the product remained intact, including if the seal and the product itself have not been used or damaged.
Notification of cancellation by the buyer shall be made by email via the contact form. In this instance and inasmuch that the buyer will have complied with the time frame specified in the above paragraph, he will receive a return shipping authorisation number. In the case of return of a parcel upon notifying chameleon-decor.com by mail within the here above specified time limits, the return shipping costs shall always be borne by the customer. The customer is further recommended to use GLS services, a chameleon-decor.com partner, for a secure and guaranteed delivery. The client will be required to protect the returned items with the utmost care.
For your convenience when you return an item, chameleon-decor.com offers you a refund by bank transfer into your bank account. To take advantage , safe and rapid service, simply fill your bank account number on the packing list accompanying the returned items. The refund will be made by bank transfer in the shortest time possible (maximum 30 days) from the time chameleon-decor.com actually knowledges your cancellation of items orders and once these have been returned to chameleon-decor.com. The shipping costs will not be reimbursed.
In the event of abusive returns, chameleon-decor.com reserves the right to reject any future order.

Section 11. Guarantees and service after sale (ASS)
Most of our items sold are covered under the legal compliance warranty, legal hidden defects’ warranty and the manufacturer's warranty which scope and duration vary according to the items and brands.
In the case of an exchange, shipping costs of the item (s) are the responsibility of the customer. However if the compliance warranty applies to the returned product(s), all return shipping costs will be reimbursed to the client.
Whatever the problem with your item, you must attach a copy of the invoice, its warranty certificate (in the box) and the return coupon with the defective product.
Please note, the warranty does not apply to damage repair when damage is the result of an external cause to the device (for example, accident, shock, lightning, a power fluctuation, the replacement of consumables such as batteries, bulbs, fuses,...). Or a fault of the customer resulting by example from a use or an installation which did not comply with the specifications of the manufacturer, from a use affecting the proper conservation of the device, from a commercial or collective use, from the use of inappropriate devices, consumables and accessories... We invite you in this respect to read carefully the instructions for use provided with the products.
In the event of products inconsistent with the information given during the presentation of the products on the website or showing hidden defects, they will be replaced or refunded based on the availability of similar products and the agreement of the customer. Returned items covered will only be accepted with the Delivery note. If the product cannot be replaced, because it is out of stock, you will receive a gift voucher of the value of your purchase price credited to the chameleon-decor.com shop.
Products modified, repaired, integrated or added by the customer or any other person not authorised by the Supplier, are excluded from the warranty. The warranty will not apply for obvious defects and compliance defects of the product for which all claims shall be made by the customer within 7 days from delivery of the products, under penalty of forfeiture. The warranty will not cover products damaged as a result of an improper use.
In all cases, chameleon-decor.com cannot be held responsible for any right to cover denied by the manufacturer for the above reasons.
All returns must be authorised by chameleon-decor.com by a return number given to the customer prior to shipping. The customer must request this return number via the contact form, after written approval by chameleon-decor.com.
Section 12. Liability
For every step to accessing the website, whether the order, delivery process or after delivery services, SPRL Direct Trading Group is only bound within the limits of due care.
Chameleon-decor.com cannot be held liable for any inconvenience or damage arising from the use of the Internet, including the interruption of service, external intrusion or the presence of computer viruses, or any event of force majeure in accordance with the case-law.
Chameleon-decor.com cannot be held liable for any damages of any kind, whether consequential damage or bodily injuries, which could result from a malfunction or an improper use of the commercialised products. The same goes for any possible modifications of products from suppliers. chameleon-decor.com liability shall be, in any case, limited to the amount of the order and may not be alleged for simple errors or omissions which might have occurred despite all the precautions taken in the presentation of products.
Chameleon-decor.com cannot be held liable to a client or a third party, for any indirect damage, operating loss, loss of profit or loss of turnover, arising in any manner whatsoever.
Notwithstanding the preceding paragraphs, chameleon-decor.com liability for these general condition terms may not exceed an amount equal to the amounts paid or payable during the transaction which originated the said liability , regardless of the cause or form of action concerned.
chameleon-decor.com cannot be held liable for non-performance of the contract entered if the product is out of stock or unavailable, in case of force majeure, disruption or total or partial strike of the postal services and means of transport and/or communications, flood, fire.
chameleon-decor.com undertakes not to disclose the information provided by clients on the website to any third party. This information is confidential. It will only be used by its internal services to process your order and to reinforce and personalise communication including with news letters / emails and as part of the website personalisation based on user preferences observed. chameleon-decor.com may provide consolidated statistics about its customers, sales, structures of trade and relating to the information on the website to trusted third parties, but these statistics will not contain any personal data.
chameleon-decor.com does not sell, market nor rent information about its customers to third parties.

Databases stored on the company SPRL Direct Trading Group computer systems and its partners in reasonably secure conditions, will be considered as proof of communications, orders and payments that occurred between the parties.
The conditions contained on this website shall apply to deliveries exclusively on the Belgian and Luxembourgian territories. Items sold by chameleon-decor.com are consistent with the description and presentation given in the catalogue. Despite all the care taken the catalogue may contain errors. We cannot under any circumstances be held liable for this.
Section 17. Transaction Storing and Archiving
Order forms and invoices are archived on a reliable and sustainable media that corresponds to a true and sustainable copy.
Section 18. Governing Law and jurisdiction
These conditions are governed by the law of Belgium. In case of dispute, the client will first contact chameleon-decor.com to find an amicable solution. Otherwise, the District Courts of Liège are solely competent, regardless of the delivery addresses and payment methods accepted.
